TOWN OF LADYSMITH: SMALL SCALE MULTI-UNIT HOUSING CHANGES

LADYSMITH – In November 2023, the Province passed new small scale multi-unit housing (SSMUH) legislation under the Local Government Act. The Town of Ladysmith and other municipalities, are required to implement zoning changes by June 30, 2024 to allow the following within single-family and duplex zones:

  • A minimum of three housing units on parcels that are 280m² or smaller; and
  • A minimum of four housing units on parcels greater than 280m² and smaller than 4050m².

The SSMUH legislation will also require that secondary suites and/or accessory dwelling units (e.g. coach houses) be permitted in all single-family residential zones, province wide.

As the Town implements the required changes it is important for landowners and builders to note the following:

  • The SSMUH legislation does not allow construction without required permits, including building permits and development permits (where applicable).
  • Exemptions will apply based on lot characteristics, infrastructure capacity and other factors. Not all properties in Ladysmith will be eligible to build to the extent allowed under the SSMUH legislation.

Municipalities have some discretion in deciding how to implement the SSMUH legislation such as setbacks and in some cases the types of housing allowed. At this time, the Town’s regulations for SSMUH implementation have not been drafted. Until the changes to the Zoning Bylaw have been adopted by Council, the current Zoning Bylaw regulations will continue to be in effect.

More information will become available as the Town implements the required SSMUH legislation.
